Terms of Service

These Terms of Service ("Terms") govern your use of the Nomy Performance app and the nomyperformance.com website (together, the "Service"), operated by Sound Performance Psychology ("we", "us", or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

You must be at least 13 years old to use Nomy Performance. If you are under the age of majority where you live, you may only use the Service with the involvement of a parent or guardian. By using the Service you confirm that you meet these requirements.

You can register with an email address or sign in with Google or Apple. You are responsible for keeping your account credentials secure and for activity that happens under your account. Please tell us promptly at hello@nomyperformance.com if you believe your account has been used without your permission.

You may delete your account at any time from within the app. Deletion removes your personal data as described in our Privacy Policy.

Nomy Performance provides performance psychology exercises, routines, and educational content designed to support people working in high-pressure environments. It is a self-guided wellbeing tool.

The Service is not a medical device and does not provide medical, psychiatric, psychological, or other professional healthcare advice, diagnosis, or treatment. It is not a substitute for care from a qualified professional. Never disregard professional advice, or delay seeking it, because of something you have read or used in the app.

If you are experiencing a mental health crisis or a medical emergency, contact your local emergency services or a crisis line immediately.

Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable licence to use the Service for your own non-commercial use. We reserve all rights not expressly granted.

You agree not to:

• Use the Service for any unlawful purpose, or in breach of these Terms.
• Copy, resell, redistribute, or commercially exploit our content without written permission.
• Reverse engineer, decompile, or attempt to extract the source code of the app, except where that restriction is prohibited by law.
• Interfere with, disrupt, or attempt to gain unauthorised access to the Service or its infrastructure.
• Use automated systems to scrape or bulk-download content from the Service.
• Share your account with others, or impersonate another person.

You keep ownership of the notes, logs, goals, and assessment responses you enter into the Service ("Your Content"). You grant us a limited licence to store, process, and display Your Content solely to operate and improve the Service for you, as described in our Privacy Policy.

You are responsible for Your Content and confirm you have the right to submit it.

The Service, including its exercises, written content, audio, design, branding, and software, is owned by Sound Performance Psychology or its licensors and is protected by copyright and other intellectual property laws. The Nomy Performance name and logo may not be used without our written permission.

Nomy Performance is currently provided free of charge. We may introduce paid features or subscriptions in the future; if we do, the applicable prices and payment terms will be presented to you before you are charged, and any purchase made through the App Store or Google Play is also subject to that store's terms.

We may change, suspend, or discontinue any part of the Service at any time. We do not guarantee uninterrupted availability.

The Service relies on third-party providers, including Google Firebase for authentication and data storage, and Google and Apple for optional sign-in. Your use of those services is also governed by their own terms and privacy policies. We are not responsible for third-party services we do not control.

The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including fitness for a particular purpose, and we do not warrant that the Service will be error-free, uninterrupted, or produce any particular result.

To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, or consequential losses, or for loss of data, profits, or opportunity, arising from your use of the Service.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot legally be excluded. If you are a consumer, these Terms do not affect your statutory rights.

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms or if we reasonably believe your use puts the Service or other users at risk. Sections that by their nature should survive termination will continue to apply.

We may update these Terms from time to time. We will update the date at the top of this page, and significant changes will be highlighted in the app or by email where appropriate. Continued use of the Service after changes take effect means you accept the updated Terms.

These Terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction, except where mandatory consumer protection law in your country of residence gives you the right to bring proceedings there.
